Public Hearing - Proposal to Sell Property Known Locally as the "Back 9" of the Big Rock Country Club Golf Course

PUBLIC NOTICE – CITY OF FAYETTE

                The City of Fayette purposes to close and vacate and then sell the following described real estate, to-wit:

I.

(Former Jeffrey J. Miller property)

The South Half of the Northwest Quarter of the Northwest Quarter, and all that part of the Southwest Quarter of the Northwest Quarter lying North of the River of Section 27; the Northeast Quarter of the Northeast Quarter, and all that part of the Southeast Quarter of the Northeast Quarter lying North of the Volga River in Section 28 (except that part thereof condemned by the City of Fayette in Book 166 Page 354); all in Township 93 North, Range 8 West of the Fifth P.M., Fayette County, Iowa;

EXCEPT

Parcel “S” of the Northeast Quarter of Section 28, Township 93 North, Range 8 West of the 5th Principal Meridian, Fayette County, Iowa, more particularly described as follows:

Commence at a found iron rod at the Northwest corner of the Northeast Quarter of the Northeast Quarter of said Section 28;

Thence South 00 degrees 39 minutes 55 seconds West, 1437.61 feet along the West line of the East Half of the Northeast Quarter of said Section 28, to a found iron rod at the point of beginning;

Thence North 89 degrees 23 minutes 49 seconds East, 419.87 feet, to a found iron rod;

Thence North 00 degrees 40 minutes 54 seconds East, 166.93 feet, to a found iron rod;

Thence South 60 degrees 00 minutes 00 seconds East, 47.31 feet, to a set iron rod;

Thence North 90 degrees 00 minutes 00 seconds East, 232.57 feet, to a set iron rod at a point of intersection with a line 15.00 feet easterly of (as measured at right angles) and parallel to the Westerly line of a 50-foot easement to Standard Oil Company, dated May 21, 1946;

Thence South 12 degrees 53 minutes 41 seconds East, 494.67 feet along said parallel line, to a set nail at a point of intersection with the centerline of Big Rock Road (66-foot right-of-way);

Thence South 83 degrees 03 minutes 43 seconds West, 476.03 feet along said centerline, to a set nail at a point of curvature with a circular curve concave Northeasterly, having a radius of 454.13 feet, a central angle of 45 degrees 18 minutes 23 seconds, and whose chord bears North 74 degrees 17 minutes 06 seconds West, 349.82 feet;

Thence Westerly along said centerline and the arc of said curve, 359.10 feet, to a set nail at a point of intersection with the aforesaid West line of the East Half of the Northeast Quarter of said Section 28;

A parcel located in the Southeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 93 North, Range 8 West of the 5th P.M., described as all that land lying North of the Volga River and South of the 146th Street Road (commonly known as Big Rock Country Club Road), located in the Southeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 93 North, Range 8 West of the 5th P.M., Fayette County, Iowa.

Parcel X in Lot 3, Block 7, River Addition to the City of Fayette, located in the Northwest Quarter of the Northeast Quarter of Section 28, Township 93 North, Range 8 West of the 5th P.M., City of Fayette, Fayette County, Iowa, and more particularly described as follows: Beginning at the Northeast corner of said Quarter-Quarter Section; thence South 00 degrees, 38 minutes, 05 seconds West 707.32 feet along a North-South Quarter-Quarter Section line of said Section and an Easterly Corporation Line of said City of Fayette to the Northeast corner of Parcel Y in said Quarter-Quarter Section; thence North 77 degrees, 22 minutes 22 seconds West 361.75 feet; thence North 64 degrees, 41 minutes, 42 seconds West 228.99 feet, both along said Parcel Y; thence North 26 degrees, 19 minutes, 25 seconds East 118.18 feet; thence North 36 degrees, 36 minutes, 17 seconds East 290.40 feet; thence North 66 degrees, 28 minutes, 26 seconds East 46.10 feet; thence North 16 degrees, 39 minutes, 47 seconds East 45.04 feet; thence North 11 degrees 22 minutes, 17 seconds West 160.00 feet to the North Section line of said Section and the Northerly Corporation line of said City of Fayette; thence South 85 degrees, 08 minutes, 00 seconds East (record bearing) 320.00 feet along said Section line and Corporation line to the point of beginning, containing 6.346 acres, subject to easements of record.

The property is known locally as the “back 9 (nine)” of the Big Rock Country Club Golf Course.

                The city of Fayette will hold a public hearing on the proposal to sell that portion of the above described property. Final approval of the sale will be via resolution following the public hearing.

                The terms of the proposal are as follows:

  1. The purchaser shall pay $1.00 and other valuable consideration pursuant to a written offer to buy which is available for inspection at Fayette city hall, all city attorney expenses, and other city costs related to the sale of this property.
  2. The purchaser shall take said property subject to all future taxes and special assessments. The Purchasers shall pay for all attorney fees, closing costs and recording fees for the transfer of this property. The City will not provide an abstract for this property.
  3. The City will reserve any necessary easements for utility purposes.

The public is invited to attend and comment on the proposal at a hearing on the 7th day of February, 2022, at 6:00 P.M. in the Community Room at the Fayette Community Library, 104 W. State Street, Fayette, Iowa.
