Council Meeting Minutes 4-17-2023

REGULAR COUNCIL MEETING

April 17, 2023

     The City Council of the City of Fayette, Iowa, met Monday, April 17, 2023, at 6:00 pm in the Community Room at the Fayette Community Library pursuant to law and rules of said council, Mayor Wood presiding. The meeting began with the Pledge of Allegiance.

     Roll call: Present - Council members Potratz, Scott and Tucker. Absent - Post and Tenney.

     Moved Potratz, seconded Tucker, to approve the consent agenda items consisting of the regular meeting minutes of 4/3/23, the claims list of 4/1/23-4/14/23 and the Class C Retail Alcohol License with Catering Privilege for ARAMARK Educational Services, LLC/Upper Iowa University. Roll call, all ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve the agenda, removing agenda item 11D, discussion and consideration in spending the library savings funds on a copy machine. All ayes, motion carried.

     Mayor Wood advised the council that he has been working with Delta Dental and the Iowa Economic Development on programs to try and bring a dentist to Fayette. There is a program, FIND - Fulfilling Iowa's Need for Dentists, Fayette is eligible for and Wood will provide more information as he continues to research. Mayor Wood also mentioned that he appreciated the work that Linda Tenney has done on the city council and wishes her and her family the best in the future.

     City Administrator/Clerk McGrane updated the council on the budget process and the N. Main Street project. McGrane also reminded everyone of Upper Iowa University's (UIU) Fayette appreciation day occurring this Wednesday, 4/19/23, and they will be working on projects throughout the community.

     Fayette Police Chief Davis informed the council he has been continuing to work on some recent police cases.      

     Fayette Public Works Director Hildebrand advised he has received the Iowa DNR permits for the water project and is waiting for a few parts.

     This being the time and place posted for a public hearing on the proposed fiscal year 2024 estimated budget, Mayor Wood opened the hearing and asked for comments. There being no comments, Wood closed the hearing.

     Moved Tucker, seconded Scott, to approve Resolution 2023-27 approving the fiscal year 2024 budget and certification of taxes. Roll call, all ayes, motion carried.

     This being the time and place posted for a public hearing on the authorization of a loan and disbursement agreement and the issuance of not to exceed $55,000 for police equipment (body cameras and tasers), Mayor Wood opened the hearing and asked for comments. There being no comments, Wood closed the hearing.

     Moved Potratz, seconded Scott, to approve Resolution 2023-28 instituting proceedings to take additional action for the issuance of not to exceed $55,000 for police equipment (body cameras and Tasers) general obligation loan and disbursement agreement and contract agreement. Roll call, all ayes, motion carried.

     Moved Potratz, seconded Tucker, to acknowledge receipt of the Fayette County Economic Development and Tourism quarterly report from January through March 2023 and the Fayette Community Library Board of Trustees meeting minutes from 2/8/2023. All ayes, motion carried.

     Moved Potratz, seconded Scott, to approve closing down the 200 block of South Main Street for the All Cardinal Reunion on July 15, 2023, from 11AM until midnight and allowing music to be played outdoors until midnight. All ayes, motion carried.

     Moved Tucker, seconded Potratz, to approve closing the 100 block of S. Main Street from 5:30PM to 9PM on the 3rd Thursday of the month starting in May until September 2023 for the Music, Motors and Market on Main. All ayes, motion carried.

     K&W Coatings, LLC, quote was presented and Mayor Wood spoke with the company and asked about not repainting Upper Iowa University on the water tower and possible replacing it with our new motto - Connecting Learning, Leisure and Life and they are estimating an additional $2,000-$3,000 to the cost in the estimate of $39,420.00. Moved Potratz, seconded Tucker, to approve moving forward with the K&W Coatings LLC quote for painting the water tower at $39,420 and to paint the tower the same as it is now including Upper Iowa University. All ayes, motion carried.

     Moved Tucker, seconded Scott, to approve setting a public hearing for Monday, May 15, 2023, at 6PM on the proposed contract documents and estimated costs for completing the recreation trail from Fayette to Volga State Park. All ayes, motion carried.

     Moved Potratz, seconded Scott, to direct the City Administrator to post and publish a notice stating that anyone interested in filling the council position for the remainder of the term to contact City Hall or Mayor Wood prior to noon on April 28, 2023. All ayes, motion carried.

     Moved Tucker, seconded Scott, to table Resolution 2023-14 of the cell tower agreement contract. All ayes, motion carried.

     Moved Tucker, seconded Scott, to go into closed session per Iowa Code 21.5(1)(j) to discuss the purchase or sale of particular real estate only where premature disclosure could be reasonably expected to increase the price the City would have to pay for that property or reduce the price the City would receive that property. Roll call, all ayes, motion carried.

     Moved Scott, seconded Potratz, to open regular session. Roll call, all ayes, motion carried.

     Moved Potratz, seconded Tucker, to direct the City Administrator to move forward with the proposed action discussed in closed session. All ayes, motion carried.

     Moved Tucker, seconded Scott, to approve Resolution 2023-25 approving Company Policy/Agency Disclosure and Acknowledgement, the Listing Agreement and the Seller Disclosure of Property Condition with starting date of 4/18/2023 and ending date of 12/31/2023 with option of renewal afterwards. Roll call, all ayes, motion carried.

    There being no further business, Wood declared the meeting adjourned at 8:18 pm.
